II. GENERAL TERMS OF USE

Purpose of the Terms: the Website

These General Terms of Use (hereinafter, the “Terms”) regulate the access and use of the Website. For the purposes of these Terms, the Website shall be understood as the external appearance of the screen interfaces, both static and dynamic, the navigation structure, and all the elements integrated in both the screen interfaces and the navigation structure (hereinafter, the “Contents”), as well as all those online services or resources offered to Users (hereinafter, the “Services”).

Ninus reserves the right to modify, at any time and without prior notice, the presentation and configuration of the Website, as well as the Contents and Services that may be incorporated therein. The User acknowledges and accepts that Ninus may, at any time, interrupt, deactivate and/or cancel any of the elements integrated into the Website or access to them.

Access to the Website by the User is free of charge, and, in general, does not require any payment in order to enjoy it, except for connection costs through the telecommunications network supplied by the access provider contracted by the User.

The use of any of the Contents or Services of the Website may require prior subscription or registration by the User.

Access, browsing, and use of the Website, as well as the use of spaces that allow interaction between Users or between the User and Ninus, such as comment areas and/or blogging spaces, confer the status of User. From the moment browsing begins, the User accepts all the Terms established herein, without prejudice to the application of the corresponding mandatory legal regulations, as appropriate. Given the importance of this, Users are advised to read these Terms each time they visit the Website.

The Ninus Website provides a wide range of information, services, and data. The User assumes responsibility for the correct use of the Website. This responsibility extends to:

  • The use of information, Contents, and/or Services and data offered by Ninus in a manner that is not contrary to these Terms, the Law, morals, or public order, or that in any other way may infringe the rights of third parties or the proper functioning of the Website.

III. ACCESS AND BROWSING ON THE WEBSITE: EXCLUSION OF WARRANTIES AND LIABILITY

Ninus will make every effort to ensure the proper functioning of the Website; however, it does not accept responsibility or guarantee that access to this Website will be uninterrupted or error-free.

Neither does it accept responsibility or guarantee that the content or software accessible through this Website is error-free or that it will not cause damage to the User’s computer system (software and hardware). In no case shall Ninus be liable for any loss, damage, or harm of any kind arising from access, browsing, or use of the Website, including, but not limited to, damages caused to computer systems or resulting from the introduction of viruses.

Ninus, by itself or as an assignee, owns all intellectual and industrial property rights of the Website, as well as all the elements contained therein (including, but not limited to: images, sound, audio, video, software, texts, trademarks or logos, color combinations, structure and design, selection of materials used, programs necessary for its operation, access, and use, etc.). Ninus reserves the right to take any civil or criminal actions deemed necessary for the improper use of the Website or its Contents, or for the breach of these Terms.

The relationship between the User and Ninus shall be governed by the current and applicable legislation in Spanish territory. Should any controversy arise regarding the interpretation and/or application of these Terms, the parties shall submit to the ordinary jurisdiction corresponding in accordance with the law.
